1. Acceptance of Terms
These Terms and Conditions constitute a legally binding agreement between you and Pelagos, a yacht charter service operating in Phuket, Thailand. By accessing our website, making inquiries, or booking charter services, you acknowledge that you have read, understood, and agree to be bound by these terms.
If you do not agree with any part of these terms, you should not use our services or website. We reserve the right to refuse service to anyone for any lawful reason.
2. Service Description
Pelagos provides yacht charter services in the waters surrounding Phuket, Thailand. Our offerings include evening twilight cruises, full-day deep-water charters, and multi-night oceanic voyages. Charter experiences are subject to availability, weather conditions, and operational considerations.
While we make every effort to provide the experiences as described, natural conditions, marine life behavior, and other factors beyond our control may affect specific elements of any charter. We do not warrant particular outcomes such as wildlife sightings or specific weather conditions.
3. Booking and Payment
3.1 Reservation Process
Charter bookings require advance reservation through our designated communication channels. A booking is confirmed only upon receipt of required deposit payment and written confirmation from Pelagos.
3.2 Payment Terms
A deposit of fifty percent is required to secure your booking, with the balance due fourteen days prior to charter date. For bookings made within fourteen days of departure, full payment is required at time of booking. Prices are quoted in Thai Baht and payment may be made via bank transfer or credit card.
3.3 Additional Costs
National park entrance fees, pier fees, and special requests outside standard charter inclusions may incur additional charges. These will be communicated clearly before confirmation.
4. Cancellation and Refunds
4.1 Guest-Initiated Cancellation
Cancellations made more than thirty days prior to charter date receive full deposit refund minus a ten percent administrative fee. Cancellations between fifteen and thirty days prior receive fifty percent refund. Cancellations within fourteen days of departure are non-refundable. These terms apply to standard bookings; custom arrangements may have different provisions.
4.2 Weather-Related Cancellation
If Pelagos determines that weather or sea conditions make charter departure inadvisable for safety reasons, you may choose to reschedule without penalty or receive full refund. This decision rests solely with our captain based on current conditions and forecasts.
4.3 Operational Cancellation
In rare circumstances where vessel maintenance issues, crew illness, or other operational factors prevent charter fulfillment, we will offer alternative dates or provide full refund. We are not liable for consequential costs such as accommodation or travel arrangements.
5. Guest Responsibilities
5.1 Health and Fitness
Guests must be in adequate health for marine activities. You are responsible for disclosing medical conditions, medications, or physical limitations that might affect your safety or ability to participate. Certain water activities require specific fitness levels; our crew will assess suitability.
5.2 Conduct and Safety
All guests must comply with safety briefings, follow crew instructions, and conduct themselves respectfully. Intoxication, reckless behavior, or failure to follow safety protocols may result in charter termination without refund. Damage to vessel or equipment caused by guest negligence will be charged to the responsible party.
5.3 Accurate Information
You must provide accurate passenger counts, dietary requirements, emergency contact information, and any other details requested for charter planning. Changes should be communicated as soon as possible.
6. Liability and Insurance
6.1 Limitation of Liability
Pelagos maintains comprehensive liability insurance covering passenger safety and vessel operations as required by Thai maritime law. Our liability is limited to direct damages and does not extend to consequential losses, opportunity costs, or expenses beyond the charter fee paid.
6.2 Personal Belongings
Guests are responsible for their personal belongings. While we take reasonable precautions, Pelagos is not liable for loss, theft, or damage to personal items. We recommend against bringing valuable items and suggest waterproof protection for electronics.
6.3 Guest Insurance
We strongly recommend that guests obtain travel insurance covering medical evacuation, trip cancellation, and personal accident. Water activities involve inherent risks, and personal insurance provides additional protection beyond our operational coverage.
7. Intellectual Property
All content on the Pelagos website, including text, images, logos, and design elements, is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without express written permission.
Guests may photograph and share their charter experiences for personal use. Commercial use of images taken aboard Pelagos vessels or featuring our crew requires prior authorization.
8. Privacy and Data
Collection, use, and protection of personal information is governed by our Privacy Policy. By engaging our services, you consent to data processing as described in that policy. We maintain passenger manifests and safety-related information as required by Thai maritime regulations.
9. Modifications to Service
While we strive to deliver charters as described, operational circumstances may require itinerary adjustments, route changes, or timing modifications. Our captain has final authority over all operational decisions affecting safety and vessel management. We will communicate changes promptly and work to maintain the core experience quality.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from charter services or these terms shall be subject to the exclusive jurisdiction of Thai courts.
Before initiating formal proceedings, parties agree to attempt good-faith resolution through direct communication. Many concerns can be addressed through discussion with our management team.
11. Force Majeure
Pelagos is not liable for failure to perform obligations due to circumstances beyond reasonable control, including severe weather, natural disasters, government actions, civil unrest, or other force majeure events. In such cases, we will work to reschedule or provide appropriate remedies.
12. Severability
If any provision of these terms is found unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed from these terms. The remaining provisions continue in full force.
13. Changes to Terms
We may update these Terms and Conditions periodically to reflect operational changes, legal requirements, or service enhancements. Changes become effective upon posting to our website. Bookings made prior to changes remain governed by terms in effect at booking time.

15. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any written booking confirmation, constitute the entire agreement between you and Pelagos regarding charter services. Verbal representations or prior communications are superseded by these written terms unless specifically incorporated into booking documentation.
